Is there any case supporting the proposition that a person can be bound by law by virtue of having an equal status?

British Columbia, Canada

The following excerpt is from Morguard Trust Co. v. Heritage Horizons Ltd., 1987 CanLII 2836 (BC SC):

At p. 322 Craig J. stated: “The only case cited in support of this proposition is Davidson v. Cooper et at. (1844), 13 M&W 343,153 E.R. 142. While the principle expressed in that case may have been appropriate in 1844, it is, in my opinion an anachronism in 1976, and, as it is not binding upon me, I would not have followed it.”
