At the same time, court orders must be complied with and non-compliance must have consequences. As Justice Chappell stated in Levely v. Levely [5]: “13 . . . Judicial response to a party's failure to respect the court process and court orders should be strong and decisive. The judge should be as creative as necessary in crafting remedies so as to ensure that the noncompliance identified and the resulting damage to the other party are addressed as fully, justly and quickly as possible.” The objective of a sanction for failing to comply with court orders: “ought not to be the elimination of the adversary, but rather one that will persuade the adversary to comply with the orders of the court[6].
