Both parties’ submissions appear to contemplate a simple set off. In any event, I conclude that a simple set off approach is appropriate: Contino v. Leonelli-Contino, 2005 SCC 63. There is no evidence suggesting that fixed or variable costs warrant adjustments or that the result under a simple set off is not an outcome that is fair in all the circumstances.
