The Court of Appeal cautioned in Condo Corp 0321365 v. MCAP Financial Corporation that one has to be careful not to confuse a statement of present fact with the future consequences flowing from the negligent misrepresentation of that fact, noting that “[m]any statements of existing facts are inextricably linked to the future and it is what happens in the future that brings home the full extent of the damages caused by the negligent misrepresentation” (at paragraph 90).
