The three principal advantages of a class action over a multiplicity of individual claims are: (1) serving judicial economy by avoiding unnecessary duplication in fact-finding and legal analysis; (2) promoting access to justice; and (3) ensuring that actual and potential wrongdoers modify their behaviour to take full account of the harm they have caused, or may cause, to the public: Hollick v. Toronto (City), 2001 SCC 68 at para. 15. Section 2 of the CPA requires a class member who wants to commence a proceeding to bring an application for certification.
