That is not the case in British Columbia. In MacKinnon v. Instaloans Financial Solutions Centres (Kelowna) Ltd., 2004 BCCA 472 at para. 33, our Court of Appeal said as follows: I think it is also clear that an action commenced under the Class Proceedings Act is, even before the certification application, more than just “any old action”: it is an action with ambition.
