Even if the parties had reached this agreement, if it was out of keeping with the amount payable under the Guidelines it would not be enforceable. As the right to child support is the right of the child, it cannot be waived by the parents: Richardson v. Richardson, 1987 CanLII 58 (SCC), [1987] 1 S.C.R. 857.
