Crewe-Read v. The Municipality of Cape Breton[4] arose out of the necessity to call in the militia to suppress riots in Cape Breton. A statute then in force provided that when a municipality was unable to quell unrest and found it necessary to call in the militia, the municipality was required to pay for the transportation and maintenance of the militia.
