This complaint arises from events during a political campaign. The electoral process is, of course, the heart of Canada’s democracy. The right to meaningfully participate in that process is enshrined in s. 3 of the Charter, which guarantees all citizens the right to vote and to be qualified for membership in a legislative assembly. Canada’s democracy is enhanced by the “enriched political debate” which occurs when a diverse populace participates in political discourse: Harper v. Canada (Attorney General), 2004 SCC 33 at para. 70.
