1 '(12) There can be little doubt but that, in a case where an employer intervenes in the employee's action for reimbursement of compensation payments paid to the employee, separate judgments may be rendered in favor of the employer and employee.' Fernandez v. Consolidated Fisheries, Inc., 117 Cal.App.2d 254, 264, 255 P.2d 863, 870 (1953).
