The following excerpt is from People v. Boyce, 110 Cal.App.3d 726, 168 Cal.Rptr. 219 (Cal. App. 1980):
Essentially, appellant is contending that evidence gained by a witness during complicity with a defendant in one crime will require that he be treated as an accomplice when he testifies to such evidence during the trial of the defendant as to another crime. Appellant has cited us no authority for that proposition. It does not appear to be the law. (See People v. Owens (1946) 28 Cal.2d 191, 168 P.2d 945.)
