Here, the defendants offer a more restrictive interpretation of the BPCPA, in which subsequent purchasers of homes with fireplaces would not come within the ambit of a “consumer transaction.” They rely on various authorities in support of their arguments including the decisions in Ladas and Bryan v. Gill, 2013 BCSC 1898.
