In The Queen v. Bartier (Appeal No. 12185, September 11, 1978) the victim was an eight year old girl, the daughter of family friends of the accused. The accused on two occasions committed an indecent assault by rubbing his male organ against the girl's vagina and achieved orgasm. The learned trial judge imposed a sentence of 30 days' imprisonment plus 18 months' probation. This Division increased the sentence to 6 months' imprisonment.
