In Ban v. Keleher, 2017 BCSC 1132 [Ban] at paras. 69 and 110, Dorgan J. found that damages could be awarded based upon a diminution in value arising from stigma, but recognized that such a loss is difficult to calculate where there is no impending or associated sale in order to crystallize the alleged loss.
