The worker, through her representative, has advanced the position that her back problems since June 2008 resulted from an index event of December 20, 2003, before which she had not experienced any issues with her back. Noting that the trivial activity of pushing a laundry basket would not be expected, in and of itself, to cause a disc herniation, I was asked to look to the underlying condition as a significant contributing factor, consistent with the analysis found in Athey v. Leonati 1996 CanLII 183 (SCC), [1996] 3 S.C.R. 458.
