Stewart v. Pettie (1995), 1995 CanLII 147 (SCC), 23 C.C.L.T. (2d) 89 [25 Alta. L.R. (3d) 297] (S.C.C.), is the leading case in this area, dealing with a commercial host. It involved an appeal from a decision holding a commercial host, a restaurant which served liquor to a driver ultimately involved in a collision, liable for a portion of the resulting injuries on the basis that it breached a duty of care by over-serving liquor to the point where the driver became dangerous to himself or others and in failing to take affirmative measures to ensure that he did no harm.
