The Union is correct that “proceeding” includes a grievance under a collective agreement, and that the grievance procedure need not necessarily proceed to arbitration in order for s. 27(1)(f) to apply: Charbonneau v. Alcan Inc. and others, 2004 BCHRT 19 at para. 16.
