Can a plaintiff succeed on a conspiracy claim?

Ontario, Canada

The following excerpt is from McTaggart v.Ontario, 1991 CanLII 8313 (ON SCDC):

Wilson J. appears to contemplate that the plaintiff may succeed on a conspiracy claim, notwithstanding failure of the other tort claims. The interrelationship of the tort claims and the conspiracy claim in this case is far closer than that in Hunt v. Carey where the plaintiff sued as a result of contracting mesothelioma due to exposure to asbestos fibres over the course of his employment with the defendants. In addition to alleging negligence, the plaintiff alleged a conspiracy to withhold information about the dangers associated with the asbestos.
