[140 Cal.App.3d 984] However, the many and significant differences between judicial proceedings and arbitrations dictate a different result in this case. To begin with, a judge receives power from the Constitution and the people and judicial action has far-reaching and precedent setting consequences. Indeed, our tripartite form of government has given the judiciary co-equal responsibility for the maintenance of social, economic and governmental order in our society. An independent judiciary is essential to the preservation of a democracy and must be protected.
