The Sixth Amendment guarantees a defendant's right to trial before an impartial jury. See Skilling v. United States , 561 U.S. 358, 130 S.Ct. 2896, 291213, 177 L.Ed.2d 619 (2010). When an impartial jury cannot be empaneled due to pretrial publicity, a change of venue at the request of the defendant is appropriate to prevent violation of the defendant's due process right to a fair trial. See id . at 2913.
