"Jury deadlock constitutes necessity for declaration of a mistrial and permits retrial of the defendant. [Citations.]" (People v. Halvorsen (2007) 42 Cal.4th 379, 425-426; see also 1140 [jury may be discharged after the cause is submitted to them if "at the expiration of such time as the court may deem proper, it satisfactorily appears that there is no reasonable probability that the jury can agree"].)
