What is the test under section 352 of the Criminal Code of Ontario to assess the probative value of evidence?

California, United States of America

The following excerpt is from People v. OGLE, No. 2008-012403), No. B214086 (Cal. App. 2010):

The trial court has broad discretion under section 352 to assess whether the probative value of evidence is outweighed by the risk of undue prejudice, consumption of time or confusion. Its determination "must not be disturbed on appeal except on a showing that the court exercised its discretion in an arbitrary, capricious or patently absurd manner that resulted in a manifest miscarriage of justice." (People v. Jordan (1986) 42 Cal.3d 308, 316.)
