The trial court in this case "carefully considered whether the proposed testimony fell within appropriate limits." ( People v. Dykes (2009) 46 Cal.4th 731, 782, 95 Cal.Rptr.3d 78, 209 P.3d 1 ( Dykes ).) When the defense challenged the prosecution's anticipated use of the officers' testimony, the court had the prosecutor make an offer of proof. The court then noted that the evidence offered by Niemi's fellow police officers was highly probative. We agree. Defendant was charged
