"A declaratory relief action requires an actual controversy relating to the legal rights and duties of the respective parties. ( Code Civ. Proc., 1060.) Courts will decline to resolve lawsuits that do not present a justiciable controversy, and justiciability involves the intertwined criteria of ripeness and standing. " ( County of San Diego v. San Diego NORML (2008) 165 Cal.App.4th 798, 813, 81 Cal.Rptr.3d 461.)
