What is the test for making a demand for restitution in a civil case?

California, United States of America

The following excerpt is from People v. Williams, 106 Cal.App.3d 15, 164 Cal.Rptr. 767 (Cal. App. 1980):

Appellant's final contention is that the People failed to make a demand for restitution prior to bringing criminal action, and therefore are barred from bringing this prosecution (citing People v. McGee, 19 Cal.3d 948, 957, 140 Cal.Rptr. 657, 568 P.2d 382). This contention is meritless.
