What is the test for making a claim for food purchased by the father on behalf of the infant plaintiff?

"New York", United States of America

The following excerpt is from Greenberg v. Lorenz, 213 N.Y.S.2d 39, 9 N.Y.2d 195 (N.Y. 1961):

I concur for modification here, but limited to the facts of this case. The infant plaintiff asked for the food purchased, and it was but normal that the father, who was in any event liable for her necessaries, should make the purchase on behalf of both (see Bowman v. Great A. & P. Tea Co., 308 N.Y. 780, 125 N.E.2d 165).
