10. Since defendant raises the issue of ineffective assistance of counsel because counsel did not object on this ground, we choose to consider the case on the merits. (People v. Neely (2009) 176 Cal.App.4th 787, 795 [an appellate court may choose to consider the case on the merits when a claim of ineffectiveness of counsel is raised].) We thus address the merits of defendant's arguments.
