MultiRegion, United States of America

The following excerpt is from Cox v. Campos, CASE NO. 06CV1523-MMA (BLM) (S.D. Cal. 2011):

favorable to plaintiff, show that the officer's conduct violated a constitutional right. 533 U. S. at 201. If the court finds no violation occurred, "[t]he inquiry ends, " and "the plaintiff cannot prevail. " Motley v. Parks, 432 F. 3d 1072, 1077 (9th Cir. 2005) (en banc). If the facts alleged demonstrate a constitutional violation, the court will then consider whether the right in question was "clearly established" such that a reasonable officer would know that "his conduct was unlawful in the situation he confronted. " Saucier, 533 U. S. at 202.
