What is the test for establishing a long-term disability based on medical opinions that predate the alleged onset of the disability?

MultiRegion, United States of America

The following excerpt is from Brooks v. Colvin, Case No. 1:11-cv-2124-SKO (E.D. Cal. 2014):

"Medical opinions that predate the alleged onset of disability are of little relevance." Carmickle v. Comm'r of Soc. Sec. Admin., 533 F.3d 1155, 1164 (9th Cir. 2008). Further, medical evidence associated with a prior, already-adjudicated disability period is irrelevant to establish a current disability, although it may be relevant to establish a condition worsened since it was considered in a prior decision. Fair v. Bowen, 885 F.2d 597, 605 (9th Cir. 1989).
