The protection afforded the defendants under the principles enunciated in People v. Gibson should not be extended beyond the facts of that case. It probably reached the border line. The establishment of a fact should be by the same methods and evidence in all classes of trials unless direct and clear constitutional or legislative enactment provides otherwise.
The order appealed from should be affirmed.
