The following excerpt is from People v. Perez, H036037 (Cal. App. 2011):

Pollard, supra, 546 F.3d 828, 832.) We conclude that this was not punishment for invoking the right to remain silent or for refusing to confess. Under these circumstances, we further conclude that defense counsel was not required to object to the court's statement and that defendant was not prejudiced by the lack of an objection.
