Three categories of evidence are normally considered in determining whether evidence supports a finding of deliberation and premeditation: (1) motive, (2) planning activity, and (3) manner of killing. (People v. Jennings (2010) 50 Cal.4th 616, 645.) Evidence in these categories does not have to be present in any particular combination to find substantial evidence of deliberation and premeditation.
