The following excerpt is from Funderburk v. General Tel. Co., 262 Cal.App.2d 869, 69 Cal.Rptr. 275 (Cal. App. 1968):
An identical problem was before this division in Kramer v. Boynton, 258 Cal.App.2d --- ****, 65 Cal.Rptr. 669, a battery case. The jury came in for the defendant. There were two possible bases for the verdict: 1. self-defense; and 2. no damages. The order granting the new trial merely specified that the evidence was insufficient on the issue of self-defense. It said nothing about damages.
