Pursuant to my concurring opinion in People v. Nunez (2020) 57 Cal.App.5th 78, 97-99, review granted January 13, 2021, S265918, I do not join in the majority's conclusion that the jury's findings must first be challenged by way of habeas corpus or other available collateral attack.
