What is the test for admitting criminal conduct in a mental health case?

California, United States of America

The following excerpt is from Cramer v. Shay, 156 Cal.Rptr. 303, 94 Cal.App.3d 242 (Cal. App. 1979):

1 Here, we are obviously dealing with admissions. One cannot very well confess that he is mentally retarded or that he is dangerous. Nevertheless, statements admitting criminal conduct would, under Cramer v. Tyars, supra, 23 Cal.3d 131, 151 Cal.Rptr. 653, 588 P.2d 793, come under the umbrella of the admission-confession concept.
