What is the test for admissible evidence in a personal injury case?

California, United States of America

The following excerpt is from People v. Gulizia, E064775 (Cal. App. 2016):

"[W]e presume that a judgment or order of the trial court is correct, '"[a]ll intendments and presumptions are indulged to support it on matters as to which the record is silent, and error must be affirmatively shown."' [Citation.]" (People v. Giordano (2007) 42 Cal.4th 644, 666.) Because the parties have not included the police report in the appellate record, we must assume it would support the trial court's findings and order.

We need not and we do not decide whether the police report was admissible. "Evidence which may be technically incompetent can sustain a finding if admitted without objection. [Citation.]" (People v. Moore (1970) 13 Cal.App.3d 424, 435-436; accord, People v. Panah (2005) 35 Cal.4th 395, 476.)
