What is the test for a motion to set aside a judgment in favour of a new trial?

California, United States of America

The following excerpt is from Lai v. Lai, B215231, No. BC370192 (Cal. App. 2010):

9. In their introduction, appellants state that an issue raised on appeal is whether the court should have granted a new trial motion and motion to set aside the judgment. Because they provide no legal argument in support of this contention, it is waived. (Nwosu v. Uba (2004) 122 Cal.App.4th 1229, 1245, fn. 14.)
