The Sixth Amendment to the United States Constitution provides that, "[i]n all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury." The Sixth Amendment right to jury trial is applicable to the states through the due process clause of the Fourteenth Amendment to the United States Constitution. (Duncan v.
