What is the state of the law in Ontario when it comes to the performance of counsel at trial?

California, United States of America

The following excerpt is from People v. Jackson, 168 Cal.Rptr. 603, 28 Cal.3d 264, 618 P.2d 149 (Cal. 1980):

Despite this abysmal performance by trial counsel, the majority uphold appellant's convictions. In so doing, they ignore that "(t)he right to have the assistance of counsel is too fundamental and absolute to allow courts to indulge in nice calculations as to the amount of prejudice arising from its denial." (Glasser v. United States (1942) 315 U.S. 60, 76, 62 S.Ct. 457, 467, 86 L.Ed. 680.)
