The jury was unable to reach a verdict as to counts 1 and 3, and the court declared a mistrial. Counts 1 and 3 were subsequently dismissed. Defendant's postverdict request to proceed in propria persona pursuant to Faretta v. California (1975) 422 U.S. 806 was granted.
