The following excerpt is from People v. Odle, 247 Cal.Rptr. 137, 45 Cal.3d 386, 754 P.2d 184 (Cal. 1988):
The multiple-murder special circumstance applies when a defendant in the present proceeding is convicted of more than one offense of murder in the first degree. ( 190.2, subd. (a)(3).) The prosecution,[754 P.2d 197] however, may properly allege only one multiple-murder special circumstance, even though a capital defendant may be charged with two or more murders in that proceeding. (See People v. Allen (1986) 42 Cal.3d 1222, 1273, 232 Cal.Rptr. 849, 729 P.2d 115; People v. Harris (1984) 36 Cal.3d 36, 67, 201 Cal.Rptr. 782, 679 P.2d 433 (plur. opn.).)
