The mental state required for proof of attempted murder is different from that required for murder itself. Murder does not require proof of an intent to kill; "[i]mplied malicea conscious disregard for lifesuffices." (People v. Bland (2002) 28 Cal.4th 313, 327.) However, "'[a]ttempted murder requires the specific intent to kill and the commission of a direct but ineffectual act toward accomplishing the intended killing.'" (People v.
