The following excerpt is from People v. Rivas, C082494 (Cal. App. 2017):
the sentencing norms established by the three strikes law led, in this matter, to a result that was arbitrary, capricious, or patently absurd given defendant's long criminal history, untreated drug addiction, poor performance on probation or parole, and low future prospects. Defendant fell squarely within the ambit of the three strikes law, and the trial court's decision against striking his prior conviction for purposes of sentencing was well within its discretion.
The judgment is affirmed.
