In 2001, a jury convicted defendant of second degree murder ( 187, subd. (a)) and other offenses based on his involvement in a gang shooting. Defendant was not the gunman but was prosecuted as an aider and abettor of the murder under the natural and probable consequences doctrine and was sentenced to prison for a total term of 40 years to life. We affirmed the judgment in an unpublished decision in 2004. (People v. Nunez et al. (June 14, 2004, G031735).)
