First, defense counsel asked to approach the bench to discuss the prosecutor's objection and the court's ruling on it. Instead the court excused the jury. Second, the judge's comments were not heard by the jury. As noted, "[w]hen an attorney engages in improper behavior, such as ignoring the court's instructions or asking inappropriate questions, it is within a trial court's discretion to reprimand the attorney, even harshly, as the circumstances require.
