The following excerpt is from The PEOPLE v. LOYD, A127031, No. CR034111 (Cal. App. 2010):
After pleading guilty to the single count charged in a 2005 information (battery upon a custodial officer, in violation of Penal Code section 243.11), appellant was sentenced to a term of eight months in prison, a term to be served consecutively with a six-year prison term he was already serving. He filed a notice of appeal but neither sought nor secured a certificate of probable cause. Although he has now served the term imposed by the trial court for the battery offense, he has filed a brief pursuant to People v. Wende (1979) 25 Cal.3d 436 asking this court to review the record and determine if there are any issues deserving of further briefing. We have done so, find none and, in view of both that fact and the clearly moot nature of this appeal, we affirm the trial court.
