The following excerpt is from People v. Parrison, 137 Cal.App.3d 529, 187 Cal.Rptr. 123 (Cal. App. 1982):
6 Shirley originally held the rule it announced was to apply to all cases not yet final. (People v. Shirley, supra, 31 Cal.3d at p. 67, fn. 53, 181 Cal.Rptr. 243, 641 P.2d 775.) Later the decision was modified and footnote 53 of the original decision was deleted. In its place the court made the following statement:
