What is the effect of a probation order requiring a defendant to pay attorney fees at his sentencing hearing?

California, United States of America

The following excerpt is from People v. Whisenand, 37 Cal.App.4th 1383, 44 Cal.Rptr.2d 501 (Cal. App. 1995):

The court also upheld the order assessing legal fees, rejecting defendant's contention that he did not expect the court to take up the matter of legal fees during the sentencing hearing. The court found that the probation report gave defendant sufficient notice that reimbursement for attorney fees would be considered at the sentencing hearing. (People v. Phillips, supra, 25 Cal.App.4th 62, 74, 30 Cal.Rptr.2d 321.)
