On May 18, 2009, the trial court filed its order denying the motion to compel arbitration. The court's rationale is stated as follows in its order: "The agreement is not mutual given the exception for injunction actions, and defendant's [sic] business justification for the provision was expressly rejected in Stirlen v. Supercuts (1997) 51 Cal.App.4th 1519 [Stirlen]." This appeal followed.
