The following excerpt is from Beck v. Bel Air Properties, 134 Cal.App.2d 834, 286 P.2d 503 (Cal. App. 1955):

Upon motion of the other defendants that such dismissal constituted a retraxit and barred recovery against them, the court granted nonsuits as to them. This court affirmed the judgment of nonsuit on appeal. A number of cases were cited to support such affirmance, in each of which judgments of dismissal were made and entered. Among such authorities was Lamb v. Herndon, 97 Cal.App. 193, 202, 275 P. 503, from which the following was quoted in 126 Cal.App. at page 254, 272 P.2d at page 52:
